Case Overview

In January 2025, West Virginia University issued a no-contact order and launched an investigation of student Eliyahu Itkowitz for religious discrimination and harassment based on the complaints of a campus dining hall employee. The employee alleged that Itkowitz handed her a copy of an “anti-Muslim” book — The Ten Big Anti-Israel Lies: And How to Refute Them with Truth, by Alan Dershowitz — and made anti-Muslim comments. WVU concluded its investigation in May, determining that no disciplinary action should be taken against Itkowitz, who denied making anti-Muslim comments. ֱ wrote WVU on June 16, urging it to lift the no-contact order and cease investigating protected speech in the future because unwarranted investigations with the threat of discipline chill students’ speech.
