Students Censored, Free Speech Under Quarantine at University of Central Florida
ORLANDO, Fla., December 4, 2006鈥擳he Foundation for Individual Rights in Education (蜜桃直播) is calling on the University of Central Florida (UCF) to repeal its unlawful and unfair 鈥渇ree speech zone鈥 policy. This policy quarantines free speech at UCF to four areas covering only a small percentage of its campus.
鈥淚t is simply unacceptable for UCF to transform the vast majority of its campus into a censorship area,鈥 蜜桃直播 President Greg Lukianoff said. 鈥淭he current policy is unconstitutional and must be repealed.鈥
鲍颁贵鈥檚 Free Assembly Areas policy states that only 鈥渇our areas shall be deemed free assembly areas for the conduct of political activity and other exercises of free speech.鈥 This policy has recently been used to stop at least two student organizations from holding protests. Last March, members of Students for a Democratic Society (SDS) and UCF Campus Peace Action gathered to protest the Iraq war in front of the student center, a heavily-trafficked area that lies outside the 鈥渇ree speech zones.鈥 As the protest got underway, campus police forced the students to vacate the area. A similar situation occurred in April, when campus police ordered students holding a teach-in about Iran outside the 鈥渇ree speech zones鈥 to disband
This fall, UCF student Patrick DeCarlo, a member of SDS, appealed to 蜜桃直播 to contest the existence of 鈥渇ree speech zones鈥 at UCF. On November 1, 蜜桃直播 wrote to UCF President John C. Hitt to inform him that 鈥渇ree speech zones鈥 are unconstitutional, as the law 鈥渄oes not support the transformation of public institutions of higher education into places where constitutional protections are the exception rather than the rule.鈥 On November 17, 鲍颁贵鈥檚 Associate General Counsel Youndy Cook responded obliquely to 蜜桃直播鈥檚 concerns by suggesting that instead of focusing on the Free Assembly Areas policy, 蜜桃直播 should take 鈥渁ll of [鲍颁贵鈥檚] regulations governing expressive activities on campus鈥 into account.
鈥淭hat鈥檚 exactly the problem at UCF鈥攖he university pretends to guarantee free expression with some of its rules and then denies free expression with others,鈥 Lukianoff said. 鈥溍厶抑辈 will continue to petition UCF until it makes all of its policies consistent with the First Amendment and opens its entire campus to free speech.鈥
Just last Tuesday, 蜜桃直播 announced that its efforts had led Clemson University to abandon its 鈥渇ree speech zone鈥 policy. 蜜桃直播 has also had success in fighting 鈥渇ree speech zones鈥 at West Virginia University, Texas Tech, Citrus College, the University of Nevada at Reno, and the University of North Carolina鈥揋reensboro.
This is the second case in which 蜜桃直播 has intervened to protect free expression at UCF. Last year, UCF charged a student with harassment through 鈥減ersonal abuse鈥 for calling another student a 鈥渏erk and a fool鈥 on Facebook.com. After 蜜桃直播 became involved in that case, UCF found the student 鈥渘ot in violation鈥 of the harassment policy.
