California Sex-Based Hostile Environment Harassment in Education Programs and Activities

Unwelcome sex-based conduct (where sex includes sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, gender identity and gender expression) that, based on the totality of the circumstances, is subjectively and objectively offensive and is so severe or pervasive that it limits or denies a person’s ability to participate in or benefit from any TCC Institution’s education program or activity. 

Nothing in this definition is intended to interfere with an individual’s rights to freedom of speech or expression pursuant to the United States Constitution, the California Constitution, and the California Leonard Law.
